Servitut versus ledningsrätt — a property-to-property right is not a utility’s statutory intrusion

Does a Swedish hall already have a cable corridor because a slide says “servitut”, or because a dated lantmäteriförrättning has actually created a ledningsrätt? Lantmäteriet’s servitut page, used here, says a servitut is a right for one property to use another property for a specific purpose. It is tied to the property, not to a person. An avtalsservitut is created by agreement. An officialservitut is created in a cadastral procedure when the right is of väsentlig betydelse. Lantmäteriet notes that the register is incomplete for official servitut created before 1972. That incompleteness is a file gap. It is not a clearance. Lantmäteriet’s ledningsrätt page and ledningsrättslagen (1973:1144) record a different object: a statutory right to build and keep a named line on another property, with compensation. A ledningsrätt can attach to a legal person — a utility — and it lasts. The published types include fibre, strong current, water and sewer, district heat, gas and oil, and masts plus necessary accessories. A ledningsrätt can be granted without agreement if the benefits outweigh the drawbacks and the route is the least-damage route. An appeal sits at the land and environment court. A detaljplan may determine that a servitut or a ledningsrätt shall be created (Planning and Building Act chapter 4 section 18). That plan sentence is not the completed förrättning. A line concession, a connection agreement and an option stay on later rows. Microsoft’s 16 November 2021 note names Gävle, Sandviken and Staffanstorp. EcoDataCenter names Falun. Google names Horndal. atNorth’s 23 February 2026 SWE04 note names Sollefteå. evroc’s 3 February 2025 note names Arlandastad. This page only asks which published property-right object the hall file is sitting on. This is orientation, not counsel.

Reading order

Seat the object before any corridor slide. A servitut is a property-to-property right for a specific purpose. A ledningsrätt is a statutory intrusion for a named line, with compensation, and it can attach to a legal person. Write which object you hold on one line before you say the cable route is settled.

Then keep avtalsservitut and officialservitut on separate rows. Agreement creates the first. A cadastral procedure creates the second when the right is of väsentlig betydelse. The register is incomplete for official servitut before 1972. An empty extract is not a clearance. It can be a missing older paper.

Then keep the detaljplan sentence and the förrättning on separate rows. Chapter 4 section 18 may determine that a servitut or a ledningsrätt shall be created. That sentence is not the completed procedure. A line concession, a connection agreement and an option stay later papers. A ledningsrätt can be granted without agreement if benefits outweigh drawbacks and the route is the least-damage route. An appeal sits at the land and environment court.

What a servitut clock and a ledningsrätt clock actually measure

A servitut measures a specific use of one property for the benefit of another property. It does not measure a utility’s statutory corridor as such. If the right is sold with the dominant property, the person changes and the paper stays. That is why Lantmäteriet ties it to the property, not to the person.

A ledningsrätt measures an intrusion for a named line type — fibre, strong current, water and sewer, district heat, gas and oil, or a mast plus accessories — and the compensation that follows. It can be granted without agreement when the statutory balance and the least-damage route are met. That is a stronger, and different, paper from an avtalsservitut.

A detaljplan sentence under chapter 4 section 18 measures an intention that the right shall be created. The cadastral procedure measures whether it was created. A line concession measures whether a strong-current line may be built and used. A connection agreement measures the customer-track bargain. Keep those four clocks on four rows.

What this page does not prove: that a named Swedish hall holds a servitut or a ledningsrätt; that a pre-1972 officialservitut is absent rather than unregistered; that compensation has been set; or that a corridor width exists. Those facts need the cadastral file.

No cited source here publishes a project-specific servitut extract, a ledningsrätt decision or a corridor width for a named Swedish hall.

Common misreads

The first misread is to treat a servitut as a ledningsrätt. One is property-to-property. The other can attach to a legal person and lasts as a statutory intrusion. The second is to treat an empty register extract as proof that no officialservitut exists. The pre-1972 register is incomplete. The third is to treat a detaljplan sentence as the completed förrättning.

The fourth is to treat a line concession as the cadastral paper. The fifth is to invent a hall corridor width. The sixth is to treat a campus town as a servitut extract. The seventh is to collapse this page into the option-agreements page or the line-concession page.

What to ask next

Ask which paper class anyone is quoting — avtalsservitut, officialservitut, ledningsrätt, a detaljplan sentence or a line concession — and which dated cadastral file you actually hold. Ask whether an empty extract has been treated as a clearance. Ask whether a corridor width has been invented.

It does not prove that a named Swedish hall holds either paper. It does not invent a corridor width for Horndal or Arlandastad. It does not treat a campus press note as a cadastral extract.
