Land option papers — deed, intention and lagfart

Does a Swedish slide that says “option” control the plot, or have you only been handed a word? Chapter 4, section 1 of the Land Code (1970:994) says a purchase of real property is concluded by a written deed signed by seller and buyer that states the price and the seller’s transfer declaration. Chapter 4, section 4 writes a two-year frame for many conditions. Lantmäteriet says the buyer shall apply for lagfart within three months after the acquisition and shall attach the original köpehandling. Those are statute and authority sentences. They are not a data-centre option product. evroc’s 3 February 2025 notice says it finalized a land purchase and building rights in Arlandastad — 4,890 square metres, a design of up to 16,000 GPUs and a EUR 600 million intention. Sollefteå’s 5 February 2026 notice says the municipality and atNorth intend to sign an establishment agreement for Hamre. Vertical Data’s 11 September 2026 notice says it signed a definitive purchase agreement to develop a data centre in central Sweden. EcoDataCenter’s 25 August 2026 notice says it will establish a third campus in Sweden. Those are operator or municipal sentences. They are not, by themselves, the deed Lantmäteriet would file. The parent land-and-property page already owns cadastral identity and easements. This page does not steal that file. It only asks which instrument is on the table. This is orientation, not counsel.

Reading order

Start with the instrument name on the paper, not with the slide title. Write whether anyone has produced a köpehandling that states the cadastral identity, the price and the transfer declaration and that both sides have signed. Chapter 4, section 1 is that list. A slide labelled option, a letter of intent, a municipal establishment agreement or an operator “purchase agreement” headline is a different object until those cells are filled. This page will not decide whether a particular option paper binds. That is counsel’s question.

Then write the clocks the statute and Lantmäteriet actually publish. Chapter 4, section 4 writes a two-year frame for many conditions attached to a purchase. Lantmäteriet says lagfart shall be sought within three months after the acquisition, with the original deed. A missing lagfart application can draw an order to file. Those clocks start from an acquisition, not from a marketing option. A three-month title clock is not a two-year condition clock.

Only then open the named Swedish rows. evroc’s 3 February 2025 notice is a finalized purchase and building-rights sentence. Sollefteå’s 5 February 2026 notice is an intention to sign. Vertical Data’s 11 September 2026 notice uses “definitive purchase agreement” on an operator page. EcoDataCenter’s 25 August 2026 notice is a third-campus establishment sentence. The parent land page already uses the evroc row as a transaction, not as a title. This page keeps that discipline and adds the statute cells the parent does not own.

What a land-control paper actually is

A land-control paper is the instrument that can be shown to a third party — a municipality, a network owner, Lantmäteriet — as the reason this project may use this cadastral unit. Chapter 4, section 1 is written as a form list, not as a data-centre product. If a cell is empty, the brief that says “we have the option” has not yet shown a deed. Whether some other paper can still bind the parties is a counsel question this page will not close.

Conditions and title are different machines. A two-year condition frame in chapter 4, section 4 is about how long certain reservations may sit on a purchase. Lagfart is the registration that the buyer is owner. Lantmäteriet asks for the official designation — the authority’s own example is Gävle Torp 1:1 — and the original deed. Digital or paper filing still needs that deed. A three-month clock that has not started is not late. It has not begun.

Operator and municipal headlines are evidence of a conversation, not of a filed deed. “Finalized land purchase”, “intend to sign”, “definitive purchase agreement” and “establish a third campus” are four different verbs. They can all be true on their own pages and still leave the chapter 4, section 1 cells empty in this register. Building rights on the evroc notice are a planning object beside the land object. A GPU count and a euro intention stay in other cells.

Foreign-investment screening and the plan file sit in other inboxes. ISP’s statute is not a lagfart. A detaljplan is not a deed. The parent land page already says to cross-check plot identity against plan and connection documents. This page only adds the deed and title clocks.

What named primary sources show

The Land Code shows the chapter 4, section 1 form list and the chapter 4, section 4 two-year condition frame. Lantmäteriet’s lagfart pages show the three-month filing, the original deed and the official designation. They do not publish a data-centre option template.

evroc 3 February 2025 shows a finalized purchase and building-rights sentence. Sollefteå 5 February 2026 shows an intention to sign an establishment agreement. Vertical Data 11 September 2026 shows an operator “definitive purchase agreement” headline. EcoDataCenter 25 August 2026 shows a third-campus establishment sentence. None of those rows is a lagfart extract in this register.

A matrix instead of a land-control winner

The table is a permission table. A filled cell is a claim the named URL can carry. An empty cell means this page will not invent a binding option or a filed title.

Do not treat a headline verb as chapter 4, section 1, and do not start the three-month clock from a slide.

Common misreads

The first misread is to treat the word option as a Swedish data-centre statute. The Land Code writes a purchase deed. The second is to start Lantmäteriet’s three-month clock from a letter of intent. The clock starts after an acquisition. The third is to treat Sollefteå’s “intend to sign” as a signed deed. Intention is a different verb.

The fourth is to treat Vertical Data’s “definitive purchase agreement” headline as a lagfart extract. This register has the operator page, not the deed. The fifth is to treat evroc’s GPU count or euro intention as land control. Those cells sit beside the purchase sentence. The sixth is to ask this page for counsel’s conclusion on whether a named option binds. The page is orientation.

What to ask next

If a brief says the project controls the land through an option, ask which named paper is a chapter 4, section 1 deed, a municipal intention, an operator headline or only a slide. If the three-month lagfart clock is printed without an acquisition date, the brief has left Lantmäteriet.

Then open the parent land page, site selection and due diligence. Those pages already own cadastral identity, comparison and the evidence list. This page only asks which instrument is named.

What this does and does not prove

This page proves that the Land Code writes a form list for a purchase deed, that Lantmäteriet writes a three-month title filing after an acquisition, and that named Swedish operator and municipal pages use purchase, intention and establishment verbs without publishing a lagfart extract in this register.

It does not prove that a named option is valid or invalid. It does not prove that a named hall has title. It does not give counsel.

Empty cells stay empty. Until a later primary source shows a deed that meets the form list, or a title extract, the land-control sentence stays a method, not a census.
