A granted lov is not an open-ended clock — PBL 9:115 starts from laga kraft

Reading order

Name the clock before you name the week. A giltighetstid is the two-year start and five-year finish that section 115 writes from the day the lov gained legal force. A tidsbegränsat bygglov is a different chapter 9 desk under section 39. A seasonal lov under section 40 is a third desk. A campus tour, a contractor diary and an operator groundbreaking are other papers. Write which lov class, which legal-force date and which startbesked you actually have before you say the hall “can wait.”

Then keep “started” on its own row. Boverket says the actual building works must have begun. A fenced plot, a stored transformer or a press note that says “construction started” is not that sentence unless the file shows the works themselves. Mark- och miljööverdomstolen P 10122-11 is the case Boverket cites for that reading. This page will not invent a hall start week from a ribbon-cutting.

Then keep legal force and immediate effect on separate rows. Section 114 says the lov normally applies at once. The committee may still decide it applies only after legal force. Starting after the lov applies, and after a startbesked, but before legal force, is on the applicant’s own risk: Boverket says the works may have to be restored if the decision is later changed. A slide that collapses those three clocks into “we have the permit” has lost the file.

Then keep named project rows as paper classes. Microsoft’s 16 November 2021 note names Gävle, Sandviken and Staffanstorp. EcoDataCenter names Falun. Google names Horndal. atNorth’s 23 February 2026 SWE04 note names Sollefteå. evroc’s 3 February 2025 note names Arlandastad. None of those pages is a section 115 clock, a section 105 notice or a startbesked.

What the clock actually measures

The clock measures a statute interval from legal force, not a reserved hall megawatt. Two years is the start gate. Five years is the finish gate. Both attach to the same legal-force day. A brochure that says “permits last five years” has dropped the start gate. A brochure that says “we have two years from the decision” has dropped legal force.

A notice measures a written row in the decision, not a silent waiver. Section 105 requires the giltighetstid to be stated. Boverket’s examples write that the lov ceases if the measure is not started within two years and finished within five years from legal force. A decision that never writes that row has not shown the notice. A seasonal lov must also state which part of the year it applies.

Immediate effect and startbesked sit on their own desks. Section 114 is not a startbesked. Chapter 10 still blocks the works until the committee writes that later paper. Boverket’s startbesked examples say the measure may not begin before that paper. Starting without it can sit on the byggsanktionsavgift page. This page will not collapse those later desks into the giltighetstid.

Keep the 1 July 2026 banner off invented new clocks. Boverket says the notices page has not yet absorbed every change from bill 2025/26:172. The quoted section 105 wording already names a byggbedömare after Act (2026:712). This page will not invent a third giltighetstid from that banner. Until Boverket rewrites the clock, the live sentences remain 115, 114 and 105 as cited.

What named primary sources show

Boverket’s notices-in-a-permit page remains the dated agency desk for the giltighetstid notice, the “actual works” sentence, immediate effect and the startbesked warning. Keep those objects attached to chapter 9 sections 105, 114 and 115. Do not invent a data-centre paragraph.

The temporary-permit page, the startbesked page and the building-sanction page remain other desks. This page will not copy their clocks. Named operator rows remain land and event papers. They do not, in the files used here, name a section 115 clock for a named Swedish hall.

Draw one page with paper rows and evidence columns. Permanent lov, temporary lov, seasonal lov, legal-force date, startbesked and actual works are different rows. Which decision, which date and which notice are different columns. Empty cells stay empty.

Common misreads

The first misread is to treat a granted lov as an open-ended right to start whenever the campus is ready. Section 115 closes that door. The second is to count two years from the decision date instead of from legal force. The third is to treat a temporary or seasonal lov as the same clock.

The fourth is to treat a fenced plot as “started.” The fifth is to collapse startbesked into the lov. The sixth is to use a groundbreaking in Luleå, Falun, Horndal or Arlandastad as proof that dated works already sit inside the clock.

What to ask next

Ask which dated paper anyone is quoting — a section 105 notice, a legal-force date, a startbesked, a temporary-permit decision, or only a contractor note — and which measure it names. Ask whether the actual-works sentence has actually been shown.

Then open the startbesked page, the temporary-permit page and the building-sanction page. If the operator will not name the legal-force date and the works, record the gap. Do not fill it from a permit-in-hand slogan. This page is not legal advice.

It does not prove that a named Swedish hall holds a dated legal-force clock. It does not invent a groundbreaking week for Horndal or Arlandastad. It does not treat a campus press note as actual works.
