Överklagande of lov versus detaljplan — two appeal clocks, not one inbox
Is a Swedish hall already safe from challenge because a slide says “the permit is final”, or because a dated appeal clock has actually closed? Boverket’s appeal-of-lov page, last changed 6 March 2026 and used here from the PBL Knowledge Bank, says a building-committee decision to grant, refuse or reject a bygglov, rivningslov, marklov or förhandsbesked may be appealed. The appeal goes to the county administrative board. The clock is either three weeks from the day the appellant received the decision, or four weeks from the day the decision was published for those who are not to be served. The appeal is sent to the building committee, which tests whether it arrived in time and then forwards the file. A later court can hear the county board’s decision; in some cases the court must send the case to the government. Boverket’s plan-appeal page, last changed 27 September 2023, records a different object. A municipal decision to adopt, change or repeal a detaljplan or områdesbestämmelser is appealed to the land and environment court. That clock is three weeks from the day the decision, or the adjusted minutes, was posted on the municipal notice board. The appeal still goes first to the municipality. Planning and Building Act chapter 13 section 11 says a plan appeal is normally open only to a person who filed written comments before granskning closed and was not accommodated — with named exceptions if the proposal changed after granskning, if the complaint is about unlawful procedure, or if the plan is expected to have a significant environmental impact of a listed kind. Chapter 13 section 2 says a planbesked and a decision to stop a plan cannot be appealed. Boverket also records a 14 September 2006 government file: sending a proposal to samråd or holding it for granskning has no rättsverkan and is not itself appealable. Laga kraft means the appeal clock has closed. It is not a startbesked. Länsstyrelsen’s three-week överprövning clock after adoption, already owned on the samråd-versus-granskning page as chapter 11 section 10, is a later state-supervision object. An översiktsplan sits under legality review in the Local Government Act — a third inbox. Microsoft’s 16 November 2021 note names Gävle, Sandviken and Staffanstorp. EcoDataCenter names Falun. Google names Horndal. atNorth’s 23 February 2026 SWE04 note names Sollefteå. evroc’s 3 February 2025 note names Arlandastad. None of those pages is an appeal file or a laga-kraft stamp. This page only asks which published appeal clock a “the decision is final” slogan is sitting on. This is orientation, not counsel.

General orientation. Assess the specific project separately. Applies to: Readers placing a “final permit”, laga-kraft or appeal-risk sentence on a Swedish hall file as if one inbox already closed every clock.
Reading order
Seat the decision class before any “final” slide. A lov or förhandsbesked is appealed to the county administrative board. A detaljplan adoption is appealed to the land and environment court. Write the class, the addressee and the clock on one line before you say the hall is safe from challenge.
Then keep the two clocks on their own rows. Lov: three weeks from service, or four weeks from publication for those who are not served. Plan: three weeks from posting on the municipal notice board. Do not paste a three-week plan clock onto a lov that was only published, not served.
Then keep standing, laga kraft and startbesked on later rows. A plan appeal normally needs a written granskning comment that was not accommodated. Laga kraft means the clock closed. It does not start the works. The chapter 11 överprövning clock after adoption stays on the samråd page. A planbesked cannot be appealed.
Then keep named project rows as geography. Microsoft Gävle–Sandviken–Staffanstorp, EcoDataCenter Falun, Google Horndal, SWE04 Sollefteå and evroc Arlandastad stay operator papers. This register does not publish an appeal file or a laga-kraft stamp for those cadastral units.

- Laga kraft is not a startbesked. A planbesked cannot be appealed.
What a lov-appeal clock and a plan-appeal clock actually measure
A lov-appeal clock measures the last statutory window to challenge a building-committee permit paper. Boverket’s 6 March 2026 page keeps the three-week and four-week variants on that row. The committee’s first job is a time test, not a new permit examination. A late appeal is to be rejected as out of time.
A plan-appeal clock measures the last statutory window to challenge an adopted detaljplan. Boverket’s 27 September 2023 page keeps the three-week notice-board clock and the land-and-environment-court door. Standing normally depends on a written granskning comment. That is why the samråd-versus-granskning page matters: a comment filed only after granskning can miss the standing row.
Laga kraft measures that the relevant appeal clock has closed. Boverket says the decision can then be executed as a decision. It does not measure startbesked, energisation or a reserved feeder. Chapter 11 överprövning measures a later state-supervision power after adoption. Do not add the two three-week clocks into a six-week hall guarantee.
Boverket also records that appealing a plan decision costs the appellant nothing and does not shift the other side’s court costs onto the appellant. That is a cost sentence about the appeal door. It is not a project-risk week and not a hall megawatt.

Planning and Building Act 2010:900 chapter 13, including sections 2, 2 a and 11, remains the statutory paper. The samråd-versus-granskning page already owns the chapter 11 överprövning clock. Named operator rows remain geography.
No cited source here publishes a project-specific appeal file, a laga-kraft stamp or a reserved hall megawatt created by a closed clock.

Common misreads
The first misread is to collapse lov appeal and plan appeal into one inbox. The doors are different. The clocks are different. The second is to treat a published lov as if everyone had been served. Boverket keeps a four-week clock for those who are not served. The third is to treat laga kraft as a startbesked.
The fourth is to treat a missed granskning comment as a later plan-appeal right. Chapter 13 section 11 is the standing rule. The fifth is to add the överprövning clock to the appeal clock and print a six-week hall guarantee. The sixth is to treat a campus town as an appeal file. The seventh is to collapse this page into the samråd page or the planbesked page.
What to ask next
Ask which decision class anyone is quoting — lov, förhandsbesked, detaljplan or översiktsplan — and which dated clock you actually hold. Ask who was served and who only saw a publication. Ask whether a written granskning comment exists.
Then open the samråd-versus-granskning page, the planbesked page, the building-permits page and the startbesked page. If the operator will not name the decision and the clock, record the gap. Do not fill it from a final-permit slide. This page is not legal advice.
- Is the paper a lov, a detaljplan or an översiktsplan — and which court or board hears it?
- Was the appellant served, or does the four-week publication clock apply?
- For a plan: was a written granskning comment filed and not accommodated?
- Has laga kraft been treated as a startbesked?

What this does and does not prove
This page proves that Boverket already publishes lov appeal and plan appeal as two different Planning and Building Act doors, with different addressees and clocks, and that laga kraft is not a startbesked — and that those facts are not a reserved hall megawatt.
It does not prove that a named Swedish hall sits inside a named appeal file. It does not invent a municipal week for Horndal or Arlandastad. It does not treat a campus press note as laga kraft.
Empty cells stay empty. Until a later primary source names the decision class, the clock and the dated file, the appeal clock stays a method, not a census. DataCenterSweden records the method.
