A plan change is not a new plan — it must still fit the original purpose

Can a Swedish hall already treat an adopted detaljplan as “flexible” because a slide says “we will just change it”, or because a dated Planning and Building Act chapter 4 file has actually tested an ändring against the original purpose? Boverket’s plan-change page, last changed on 31 May 2023 and published on 30 May 2016, says a detaljplan remains until it is repealed, replaced or changed. A change covers altering, removing or adding provisions inside a planned area, and repealing a geographic part of the plan. A change may be used to adapt the plan to new conditions without doing the whole suitability test of a new plan. The Act has no stated outer limit, but the change shall meet the Act’s clarity duty and shall fit the purpose of the original plan. The municipality decides whether a change is suitable in the individual case. A change cannot enlarge the plan area, because the new land has never been suitability-tested. There can be only one detaljplan for a geographic area, so there are no parallel “tilläggsplaner”: the change is written into the original plan. When the change gains legal force, it is the plan in its changed form that applies. Boverket’s regulations and general advice (2020:8) on the plan description, chapter 2 section 15, say that at a change decision sections 1 to 14 of that chapter do not apply, and that the municipality shall supplement the plan description with the intention, why a change was chosen instead of repeal or a new plan, what is changed, the consequences, how chapter 2 interests were weighed, the motives for the individual new rules, the genomförandetid for the changed provisions, and a list of new planning studies. Those are statute and agency sentences. They are not a reserved megawatt, not a planbesked and not a Meta Luleå, Microsoft Gävle–Sandviken–Staffanstorp, Google Horndal, EcoDataCenter Falun or atNorth SWE04 rezoning. This page only asks which published change object the hall file is sitting on. This is orientation, not counsel.

Reading order

Name the original purpose before you name the change. Boverket’s “what may be changed” page, last changed on 1 December 2025, says a change may be made if it is compatible with the plan’s purpose, with the other provisions and does not otherwise cause inconvenience. Planning and Building Act chapter 4 section 32 says the intended regulation shall be clear from the plan and that the plan shall not be more detailed than the purpose requires. The same page, citing government bill 1990/91:146, says that if the municipality intends to change the land-use purpose definitively, the old plan needs to be replaced by a new one. A slide that says “the industrial plan can take a hall” has not shown that purpose test.

Then keep the owner-protection clock on its own row. Chapter 4 section 39 says a detaljplan may not be changed or repealed before the genomförandetid ends if a concerned property owner objects, unless the change is needed because of new circumstances of great public importance that could not be foreseen, or to introduce property-division rules under section 18 second paragraph. That lock is not a hall veto and not a promise that the municipality will change the plan after the clock.

Then keep a genomförandetid extension on the page that already owns the clock. Section 24 lets the period be extended by at most five years at a time before it ends, and renewed by at most five years after it has ended. Chapter 5 section 38 a lets a prolongation skip certain notices and the review, and limits samråd to the cadastral authority and known concerned owners. That simplified door is not a land-use rewrite.

Then keep named project rows as paper classes. Microsoft names Gävle, Sandviken and Staffanstorp. EcoDataCenter names Falun. Google names Horndal. atNorth’s SWE04 note names Sollefteå. evroc names Arlandastad. None of those pages is an adopted ändring, a supplemented plan description or a section 39 owner-consent file for a named Swedish hall.

What a change actually measures

A change measures an edit inside an existing suitability test, not a new campus use. Boverket writes that smaller edits of use provisions can be possible if the original structure is kept and the purpose still holds, and that larger land-use shifts need a new plan. Taking a small piece of a nature area for a turning head may fit; rewriting the whole use to a hall campus may not. The municipality decides. A brochure cannot.

Clarity measures whether the changed plan can still be read. Chapter 4 section 32 and government bill 1990/91:146, as Boverket cites them, say a long chain of changes can make the plan unreadable, and that a new plan is then the lawful door. When the change has legal force, only the changed form remains. There is no second sheet that “sits beside” the original.

The supplemented description measures eight named items, not a marketing addendum. BFS 2020:8 chapter 2 section 15 asks for intention, the choice of change over repeal or a new plan, the edit, the consequences, the chapter 2 weighing, the motives, the genomförandetid for the edited rules, and new studies. A one-line “updated for data centre” note has not shown that list.

The process page says the starting point is the same procedure as a new plan, with simplified doors only for a genomförandetid extension and, after that clock, for removing property-division rules. A change that would have a significant environmental impact, a significant public interest or that conflicts with the översiktsplan is, Boverket writes, probably too large to be handled as a change.

What named primary sources show

Boverket’s plan-change hub, the “what may be changed” page and the process page remain the dated agency desks used here. Planning and Building Act chapter 4 sections 24, 32 and 39 and chapter 5 section 38 a remain the statute. BFS 2020:8 chapter 2 section 15 remains the description list.

Those pages do not, in the files used here, name an adopted ändring for a named Swedish hall. Named operator rows remain geography.

A matrix instead of a rezoning slogan

Draw one page with paper rows and evidence columns. Original purpose, change inside that purpose, new plan, section 39 lock, genomförandetid extension and planbesked are different rows. Who objected, which provision moved and which date gained legal force are different columns. Empty cells stay empty.

Do not invent a national hall-rezoning week from those desks.

Common misreads

The first misread is to treat an ändring as a new detaljplan. The second is to treat a land-use rewrite as still “inside the purpose.” The third is to invent a tilläggsplan that sits beside the original. The fourth is to treat a five-year genomförandetid extension as a use change.

The fifth is to ignore section 39 while the implementation clock is running. The sixth is to treat a planbesked as this change. The seventh is to use a groundbreaking in Luleå, Falun, Horndal or Arlandastad as proof that a named ändring already exists.

What to ask next

Ask which dated paper anyone is quoting — a purpose sentence, a supplemented description, an adopted change, a section 39 objection, or only a contractor note — and which provision it names. Ask whether the live door is a change, a new plan or only a slogan.

Then open the planbesked page, the samråd page and the genomförandetid page. If the operator will not name the original purpose and the edit, record the gap. Do not fill it from a rezoning slogan. This page is not legal advice.

What this does and does not prove

This page proves that Boverket already publishes ändring as an edit that must fit the original purpose, with a one-plan rule and a section 39 owner lock — and that those facts are not a reserved hall megawatt.

It does not prove that a named Swedish hall holds an adopted change. It does not invent a rezoning week for Horndal or Arlandastad. It does not treat a brochure as a purpose test.
