Förhandsbesked is not a building permit — and it is not Svenska kraftnät’s förhandsbesked

Reading order

Seat the letterhead before you reuse the Swedish word. A PBL förhandsbesked is a building-committee location ruling outside a detaljplan. Svenska kraftnät’s förhandsbesked is a TSO paper on the early-indication page. Write which issuer you hold before you say the site is cleared.

Then read the PBL notice as a location paper, not as a permit and not as a start. Chapter 9 section 41 limits it to permit-required measures outside a detaljplan. It is voluntary. It cannot be sought for marklov or rivningslov. Chapter 9 section 42 binds the later bygglov for two years after legal force. Boverket’s examination page says work still needs bygglov and startbesked.

Then keep chapter 9 section 74 on its own row. A positive notice may be given only if the measure does not conflict with area regulations, does not require planning under chapter 4 sections 2 or 3, and meets chapter 2 location requirements in the unexamined parts. A measure that needs a new detaljplan is not this paper.

Then keep named project rows as paper types. evroc’s 3 February 2025 Arlandastad text records a land and building-rights purchase. Google Horndal’s groundbreaking is an operator event. Microsoft’s 16 November 2021 municipalities are geography. This register has Boverket guidance but no project-specific PBL förhandsbesked for those halls.

What a location clock and a permit clock actually measure

Chapter 9 section 41 measures a location question outside a detaljplan, not a building design. Boverket says the examination looks at site suitability, including most chapter 2 requirements in the parts not already examined in area regulations. Placement and design of the building stay for the later bygglov.

Chapter 9 section 42 measures a two-year binding window after legal force, not a construction timetable. If the bygglov application does not arrive in time, the notice lapses. Binding means the committee, at the later permit, may only examine questions that the förhandsbesked did not decide.

Chapter 9 section 99 measures a handling clock for lov and förhandsbesked: in the normal case, a decision within ten weeks from the complete application day, with later starting points if the applicant adds material or if Försvarsmakten or Myndigheten för civilt försvar must answer. A late fee reduction under chapter 12 section 8 a is a fee rule. It is not a reserved megawatt.

Chapter 9 section 74 measures when a positive notice may be given. A measure that requires planning under chapter 4 sections 2 or 3 fails that test. The planbesked page already owns the later start-of-planning paper. A positive PBL förhandsbesked does not create a detaljplan and does not create a TSO reservation.

Boverket’s förhandsbesked page remains the dated national commentary for the separate case, the voluntary ask, the fee, the appeal, chapter 9 sections 41–42 and the two-year binding window. The examination page remains the dated source for the not-a-start sentence and for chapter 9 section 74.

What to ask next

Ask which förhandsbesked anyone is quoting — building committee or Svenska kraftnät — and which dated decision you actually hold. Ask whether the plot sits outside a detaljplan. Ask whether a two-year binding window has been treated as a start. Ask whether chapter 9 section 74’s planning test has been skipped.
